Remember you are not required to answer potentially incriminating questions a very polite, “I would like to speak with my attorney before I answer any questions” is a good reply. On the other hand, saying that you had one or two beers in and of itself is not incriminating, (it’s not sufficient to cause intoxication and it may explain the odor of alcohol on your breath), but just remember the officers ears are going to perk up when they hear you admit that you had consumed alcohol and are now driving a vehicle.
